Acceptable Use Policy

This Acceptable Use Policy (“Policy”) sets out the rules that apply when you access or use the FairByDesign website, publications, courses, membership areas, tools, and related services (together, the “Service”). It supplements, and forms part of, our Terms and Conditions. Words with capitalized initial letters have the meaning given to them in the Terms and Conditions.

By using the Service you agree to this Policy. If you do not agree, you must not use the Service.

1. Purpose and scope

The purpose of this Policy is to keep the Service safe, lawful, and useful for everyone. It applies to all visitors, registered account holders, members, subscribers, and any other person who accesses or uses the Service in any way.

2. General rules

You agree that you will use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service. You are responsible for all activity that takes place through your account or connection.

3. Prohibited uses

You must not use the Service:

  • In any way that breaches any applicable local, national, or international law or regulation.
  • In any way that is unlawful or fraudulent, or that has any unlawful or fraudulent purpose or effect.
  • To harm or attempt to harm minors in any way, or to transmit material that is harmful to minors.
  • To send, knowingly receive, upload, download, use, or re-use any material that is defamatory, obscene, offensive, hateful, harassing, threatening, or otherwise objectionable.
  • To impersonate or attempt to impersonate FairByDesign, a FairByDesign employee or contractor, another user, or any other person or entity.
  • To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
  • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or that, as determined by us, may harm FairByDesign or users of the Service or expose them to liability.

4. Content standards

These content standards apply to any material that you contribute to the Service, including comments, submissions, uploads, and any interaction with other users (“Contributions”). You must comply with the spirit and the letter of these standards. Contributions must:

  • Be accurate (where they state facts) and genuinely held (where they state opinions).
  • Comply with all applicable laws in any country from which they are posted.
  • Not infringe any copyright, database right, trademark, or other intellectual property right of any other person.
  • Not contain any material that is defamatory, obscene, hateful, or inflammatory, or that promotes violence, discrimination, or illegal activity.
  • Not be threatening, abusive, or invade another person’s privacy, or cause annoyance, inconvenience, or needless anxiety.
  • Not be used to impersonate any person or to misrepresent your identity or affiliation with any person.
  • Not give the impression that they come from or are endorsed by FairByDesign if that is not the case.

You retain ownership of your Contributions, but by submitting them you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and moderate them for the purpose of operating and improving the Service, as further described in our Terms and Conditions.

5. Security and system integrity

You must not misuse the Service by knowingly introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful. In particular, you must not:

  • Attempt to gain unauthorized access to the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
  • Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures, without our express written permission.
  • Access, tamper with, or use non-public areas of the Service, or the accounts of other users.
  • Use any robot, spider, scraper, or other automated means to access, harvest, or index the Service or its content without our prior written consent, or in a manner that places an unreasonable load on our infrastructure.
  • Circumvent, disable, or otherwise interfere with any paywall, membership gate, licensing, or access-control feature of the Service.

Breaching this section may be a criminal offense under applicable computer-misuse laws. We may report any such breach to the relevant law-enforcement authorities and cooperate with those authorities, including by disclosing your identity to them.

6. Intellectual property and paid content

The content, research, courses, tools, frameworks, and materials made available through the Service are protected by intellectual property rights and, where indicated, are available only to members or subscribers. You must not copy, redistribute, resell, publish, or make available any paid or member-only content to non-members, except as expressly permitted in writing. Open-source tools and third-party resources referenced within the Service remain subject to their own licenses.

7. Suspension and termination

We will determine, in our discretion, whether there has been a breach of this Policy through your use of the Service. When a breach has occurred, we may take any action we deem appropriate, including:

  • Immediate, temporary, or permanent withdrawal of your right to use the Service.
  • Immediate, temporary, or permanent removal of any Contribution.
  • Issuing a warning to you.
  • Suspending or terminating your account, membership, or subscription without refund where the breach is serious.
  • Taking legal proceedings against you, and/or disclosing such information to law-enforcement authorities as we reasonably feel is necessary.

We exclude our liability for all action we may take in response to breaches of this Policy. The actions described above are not limited, and we may take any other action we reasonably deem appropriate.

8. Reporting a violation

If you become aware of any use of the Service that breaches this Policy, or of any content that infringes your rights or the rights of others, please contact us at info@fairbydesign.org so that we can investigate.

9. Changes to this Policy

We may revise this Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes, as they are binding on you. Some of the provisions contained in this Policy may also be superseded by provisions or notices published elsewhere on the Service.
